CGT for overseas property

Postby Pinecone » Sun Nov 19, 2023 11:09 pm

I originated from another country and relocated to the UK 15 years ago. I am now UK resident.
About 20 years ago (that’s before I moved to the UK) my dad gifted me a property in a foreign country. Now, I am thinking about selling it. There is likely to be a good increase in the value over the 20 years.
I understand foreign property is also subject to CGT. But that country has exchange restriction. It’s unlikely I can remit the sales proceed back to the UK. And without the sales proceeds I may not be able to have the money to pay for the CGT. Would HMRC take that into account in charging CGT?

Yes, you can get relief under s.279 TCGA 1992:

https://www.legislation.gov.uk/ukpga/1992/12/section/279/enacted

You will need to claim the relief while it remains impossible to remit the proceeds to the UK.

Not certain but I suspect you claim the relief in a tax return. You may be able to do it by letter if you do not submit a return but that's speculation on my part.
