I currently live in the UK and work for several companies. I have my own company supplying international business, financial and legal advice. I plan to spend 5 months of the year in Australia, and the remainder of the year predominately in the UK and then a month or two elsewhere. 75% of my work can be carried out remotely.

I have several shareholdings in UK companies that may yield large returns either from dividends or via company sale.

I also have funds in a single property that I may re-invest to realise income from rentals or other property developments, not necessarily in the UK.

Is there any way to jump between countries and realise all my investments in a tax-free country?

Can anybody recommend somebody to best advise on this and to manage my affairs? I also represent several other individuals and private companies seeking the same advice.

Based on the limited information you have provided, you are likely to be treated as resident in the UK and possibly also in Australia. If this is the case primary taxing rights will be determined by reference to the Double Tax Treaty between the two countries. This would establish which country is able to tax each source of income or gain. In some, or all circumstances, both states may be able to tax each source/gain (subject to double tax relief).

It may be possible for you to restructure your affairs to avoid being resident in one or both countries thus giving a potential tax advantage.

The Forum does not provide sufficient scope to elaborate on the specific examples of income (dividends, rentals, property development) or gains (sale of company, property), but it should be possible to arrange the optimum situs of each asset, or your place of residence, to minimise your exposure to tax.

You should really seek early professional guidance.

My firm specialises in this area of taxation. If you would like us to assist you further we would be delighted to do so.
