False Self-Employment

Postby granitehead » Mon May 20, 2019 2:22 pm

Will be working in Ireland 8 days a month and rest working from home in UK

The 8 days I intend to pay TAX + NIC (PRSI) in Ireland - through a PAYE Umbrella company.

The days worked in UK from home will be declared as a sole trader self employed.

I cannot work as a LTD company as I would be inside IR35.

In this instance would I be caught by the False self-employment rules or would I be exempt as working from home is excluded from this rule?

Depends on the facts. But if you think you'd be caught under ir35 then likely you're an employee.

There are a number of issues in this arrangement, including social security, recommend you get proper support.
