UK Resident test

Postby somartinez » Sun Jan 24, 2021 5:18 pm

Hi all,

I'm having a bit of trouble defining whether or not I can be considered UK resident. I have a rented apartment in the UK however have been living in Portugal for more than 183d. Nevertheless, am I right to say that if I spend 31 working days in the UK in the tax year, as I have a rented property, I am resident in the UK and therefore can be subject to UK tax?

Thanks,
Sofia

No.

Broadly, you will be UK resident if you spend at least 30 days in the UK given your rental is your UK home.

Do you have a home in Portugal?
