Gift of cash and poat

Postby vik2001 » Tue Mar 10, 2020 10:47 pm

Mother lives at home she has gifted with son. Mother is caught by grob rules. Son is at the same home to.

Can son gift a large amount of cash to mother to buy her own place so its releases the grob she has? Will this be caught by grob or poat in anyway?

Can the mother not pay a market rent for occupation of the home and potentially avoid the GWROB rules that way? is it practical for the mother to move out as I would suspect she would want to remain in her home? All that aside, it is possible for there is a pre owned asset tax issue depending on the exact circumstances and how the tracing rules could apply.

Paying market rent is to expensive for us.
Its not practical for mother to move out. Worst thing in world. But with this grob if something was to happen you cant pass on the rnrb and tnrb because we have a joint tenancy. Its such a mess as it does t form part of estate.
So we need to find a solution so family members are not hit one day in future with a big tax bill.
