10 year charge

Postby worden » Sat Jun 06, 2020 12:48 pm

Hi there hoping someone can advise

I am trying to fill in form 100d too declare 10 Year anniversary. A discretionary Trust was set up by D.O.V nearly ten years ago when part of house left in a Will was put into Trust. The money left in the Will was distributed elsewhere as requested in original Will. The Dov was completed within the 2 years, and therefore Date of death being start date of Trust. in section 1.13 it asks if the settlor made any other settlements on the same day as this settlement. Does the money left in the Will need to be included here or is this not a Settlement ? excuse my ignorance !!!

many thanks

Only if it was left on a "proper" trust. Ordinary legacies of lump sums or shares of the estate are not settlements.

Thank you Goodman. And could u possibly confirm --the 10 year anniversary would be 10 years since the death of the settlor not when the Trust was set up by D.O.V ???

thank you so much for your help .
