Limited company inheriting residential property via Deed of Variation

Postby Ali_East Anglia » Sun Oct 18, 2020 9:47 pm

A family member ('Anne') passed away last year and her family wondered if it would be a good idea to set up a limited company ( 'New Co. Ltd') that could inherit her home through a Deed of Variation to her will. If so:
Would New Co. have to pay any tax on inheriting the property?Would New Co. inheriting the house reduce the value of Anne's estate and therefore mean that the estate was liable for less inheritance tax?
Could New Co. then sell the property for say £5, to a family member without the purchaser or New Co. having to pay tax?
Thanks for any advice.

Did Anne make a will?
If so to whom did Anne leave her home under her will?

If the original beneficiary redirects the home to a limited company the IHT on here estate will either remain the same or will in fact increase.

Why doesn't the original beneficiary by way of a DoV simply redirect the home to the family member who you indicate would purchase it from the company?

As maths said, IHT would remain the same at best.
