Hi there

can someone please clarify.

with the new changes in probate if person has died after jan 2022.

is it still necessary to submit IHT forms if there is no tax to pay ,? This would mean after claiming transferred resident and nrb from spouse, and also having made a gift in previous 7 years that is now classed as a failed PET. However taking all this into account there would be no IHT to pay ?

further to this --- as it is my understanding that i do need to submit ( but checking, as not sure) as gift was for £450K .

As there is still no tax to pay , do i need to wait 20 days before applying for probate ?

If you need to claim the residential nil rate band then you likely still need to submit, in which case you still need to wait the 20 days
