P45 query

Postby lucky62 » Sun Oct 29, 2017 1:58 pm

morning

Please can someone help? I've recently changed jobs but my previous manager was late in registering my leaver details (date of resignation) which meant that I didn't get a P45 on my last day of employment (29.09.17). They still owed me some holiday pay which has subsequently been paid 28.10.17 and now they have sent me a P45 with the tax code of OT. Is this correct?? On parts 2 and 3 (for my new employer) there are no totals given in boxes 'Total pay to date' and 'Total tax to date' (even though on my part (part 1A) it gives the figures for 'total pay in this employment' and 'total tax in this employment'). Doesn't my new employer need to know these amounts also?

Thanks in advance
Graham

Don't pass it on to your new employer. Simply sign the (correct) declaration on the new starter form that they should give you. HMRC will sort the tax code issue out.

Really ? I'm a bit confused by this - my new employer hasn't given me a 'new starter' form to complete.

Tell them that you don't have a P45, and ask for one (there's a blank available at https://www.gov.uk/government/uploads/s ... t_v1.0.pdf)

... the thing is I have already been paid by my new employer using the OT code anyhow.

That's because you didn't complete the new starter declaration. However, if you have already been paid then your employer should have made the necessary RTI submission to HMRC, which should lead to them issuing a corrected tax code.

.... ok thanks for that. Do you suggest I wait and see... or should I still complete the new starter form ?

It may be a little late, now. Your employer should have asked about this when you first started. When were you last paid, and when are you next due to be paid? If you are midway between and have heard nothing from HMRC I'd be tempted to give them a ring to have a correct tax code issued.

.... ok thanks... I'm being paid weekly by new employer since I started on 1st October. Just been paid again today and have noticed my tax code is till OT. Think I will wait until next week's pay as it's just been a month since I started but yes I'm very annoyed by my previous and new employer for not doing things the right way. In retrospect I should have completed the new starter form and took it with me on first day in my new employment but then I didn't know I was going to have this problem. The onus should not have been put on me to sort out, am I right ?? What do you think?
