can accountancy costs in a non negligent/fraudulent case be offset against the tax year being investigated as opposed to the current tax year when taxed at 22% against 40%

It seems unlikely - we are simply looking at the normal rules here and the expenditure can only be allowed against income when it is incurred, which is during the period of the enquiry.
